The law gives people a right of self-defence called private defence in case of physical attack or an apprehesnion of the same

The right of self-defence is included in the Indian Penal Code sections 96–106

Apprehension is included in the right to self-defence

There is no right of self-defence-

• Against the acts of a public servant; and
• Against the acts of those acting under their authority or direction;
• Where there is sufficient time for recourse to public authorities; and
• The amount of harm that may be caused shall in no case be in excess of harm that may be necessary for the purpose of defence

In the following instances, death can be an acceptable consequence in the name of self-defence- *Assault that may cause apprehension of- *

• death
• grievous hurt
• committing rape
• gratifying unnatural lust
• kidnapping or abducting
• wrongful confinement
• Throwing or administering acid or an attempt in this direction

The law protects people against all kinds of abuse, including verbal abuse. Chapter 22 of IPC deals with criminal intimidation, insult and annoyance. Section 294 is against obscene acts and songs and holds people accountable for their misconduct. This section holds that verbal abuse needn’t happen in a public place for it to qualify as an offence

The Indian Penal Code says that the right to defend extends to others’ defence and to own and others’ property

The right to private defence extends to property and the following conditions are essentials to exercise the right when-a person commits-

• Robbery
• Housebreaking at night
• Mischief by fire on any building, tent or vessel, which building, tent or vessel is used as a human dwelling, or as a place for the custody of property
• Theft, mischief or house-trespass that may cause a reasonable apprehension of death or grievous hurt
